Overview
The Niagara Frontier Transportation Authority (NFTA) located in Erie and Niagara County, New York, is seeking proposals from qualified parties interested in entering into a Lease Agreement for a one-story class C -13,244-square-foot building containing office, and warehouse space, and 402 square foot storage garage (not included in the building’s gross building area) located at 235 Aero Drive. The property is located on the south side of Aero Drive adjacent to the Buffalo Niagara International Airport, in Cheektowaga, New York. Site improvements include a paved parking lot and associated driveways.
The building was originally constructed as a light manufacturing/warehouse facility and has since been renovated, with much of the former manufacturing and warehouse areas converted to office and related space. The building is currently configured with 6,734 square feet of office space, 4,800 square feet of laboratory space, and 1,682 square feet of warehouse/storage space.
The primary office area includes a vestibule and reception area, private offices, a conference room, and an open lounge area with kitchenettes and televisions, along with gender lavatories. A secondary office area located adjacent to the warehouse contains several offices and storage rooms as well as an additional lavatory. Office finishes are modern and in average to good condition and include painted drywall walls, vinyl plank flooring, suspended ceilings with acoustic tiles, and recessed fluorescent lighting.
The laboratory area is arranged into three primary sections used for design and manufacturing. These areas generally feature open layouts with design workstations, specialized tools, and small- to mid-sized manufacturing equipment. The space also includes plumbed work areas with stainless steel sinks and counters. Interior finishes include painted drywall walls, resilient tile flooring, and suspended ceilings with acoustic tiles and box lighting. The laboratory area has a level of finish that is inferior to the office areas but significantly superior to the warehouse space.
The warehouse area measures approximately 1,682 sf and has an open layout served by two grade-level overhead doors. Finishes are minimal and consist of exposed concrete block walls, exposed concrete floors, and exposed metal roof trusses.
The property has a dedicated parking lot. Any prolonged storage or parking (72 hours or longer) of any vehicle, including commercial or recreational, camping trailer, utility trailer, storage container, boat and/or motorhome is strictly prohibited.
Terms
The terms of the agreement shall be a minimum of three years to a maximum of five years with renewal options negotiable. The minimum asking price is $12.50 psf with 3% annual escalation. The agreement will grant Tenant use of the premises in an “as is” condition; the Tenant is responsible any and all improvements to make the premises suitable for the intended purpose. Tenant will be responsible for base rent, non-structural repairs and maintenance, utilities, landscaping and snow removal.
Insurance Requirements
At all times throughout the term of this Agreement, Tenant agrees to procure and maintain at its expense insurance of the kinds and in the amounts hereafter required, with insurance companies licensed to do business in New York State, covering all operations under this Agreement whether performed by it or its sub-tenants. The insurance companies affording coverage must be deemed acceptable to the Authority throughout the term of this contract. If any insurance company is deemed unacceptable to the Authority the Tenant agrees to procure and maintain at its expense coverage with an acceptable insurer as soon as notified by the Authority. The policies shall provide for a 30-day notice to the Authority prior to termination cancellation or change and the Niagara Frontier Transportation Authority shall be listed as Certificate Holder.
Tenant shall supply the Authority certificate(s) of insurance providing evidence of insurance coverage for the Tenant for the following coverage:
Commercial General Liability Insurance including coverage for property damage, bodily injury, personal injury and completed operations with a single limit of at least $1,000,000 per occurrence with a $2,000,000 aggregate. The certificate shall name the Niagara Frontier Transportation Authority as an additional insured.
If any motor vehicle is used in the work, Auto Liability Insurance covering bodily injury and property damage with minimum combined single limit of $1,000,000. The certificate shall name the Niagara Frontier Transportation Authority as an additional insured.
Workers’ Compensation and Employer’s Liability in accordance with the applicable laws of the State of New York
Coverage for damage to rented premises of $500,000.
The Authority and the Tenant agree to waive all rights against each other for damages to the extent covered by the insurance. The Tenant shall require similar reciprocal waivers by all sub-tenants. This policy shall recognize such waivers of recovery by an appropriate Waiver of Subrogation Clause Endorsement, excluding any subrogation rights granted under New York Law to the contrary notwithstanding. Above needed insurance coverage should be provided on a primary and non-contributory basis.
Copies of any required policies shall be provided to the Authority upon request. The Authority has the right to modify insurance requirements as conditions warrant.
