The Borough of McClure will receive sealed bids for “Station Park Renovation” via the PennBid Program (http://pennbid.bonfirehub.com) or one (1) original and one (1) copies at their office at One North Forbes Street, McClure, PA, 17841 until January 30, 2025, at 2pm at which time and place bids will be publicly opened and read aloud. The project consists of the following: Installing an ADA handicap parking area, replacing existing sidewalks, new pavilion, restrooms, a rain garden, paving patch, seeding and mulching, etc. A non-mandatory Pre-Bid Meeting will be held for prospective bidders at the Borough Office located at One North Forbes Street, McClure, PA on January 21, 2025, at 2pm. Bidding Documents are available at no cost via the PennBid program or copies of the Contract Documents may be examined and obtained at the Borough of McClure office located at One North Forbes Street, McClure, PA 17841 by appointment. Bidding Documents may be obtained for a non-refundable fee of $75.00. Checks shall be made payable to the Borough of McClure. Bidders shall submit all questions about the meaning or intent of the Bidding Documents via the “Messages/Vendor Discussions” feature in PennBid no later than five (5) days prior to the date of receipt of bids or by email on phone call to the Engineer, CES Engineering, LLC (Sarah Keck); at (814) 644-6621, or via email at skeck@ces-engr.com. A certified check or bank draft payable to the order of The Borough of McClure, or a satisfactory Bid Bond executed by the Bidder and an acceptable surety in an amount equal to ten percent (10%) of the total of the Bid, shall be submitted with each bid. The Bidder shall include the fully completed Non-Collusion Affidavit with the bid. A Performance and Payment Bond in an amount equal to 100% of the amount of the contract and a Warranty Bond for 10% of the amount of the contract issued by a corporate surety authorized to do business in the Commonwealth of Pennsylvania will be required to be furnished by the successful bidder. Compliance with Act 127 of 2012 requiring all contractors and subcontractors to use e-Verify for verification of employment eligibility for all employees will be required. A verification form shall be provided to the Borough of McClure as a precondition of being awarded a contract. In addition to the Equal Employment requirements of Executive Order 11246 regarding discrimination, the CONTRACTOR must establish a 6.9% goal for female participation and a 1% goal for minority participation in his/her aggregate on-site construction workforce for contracts in excess of $10,000. The Borough of McClure is utilizing federal funds for this project and has adopted a Minority and Women Business Enterprise (MBE/WBE) plan in accordance with Executive Orders 11625, 12138, and 12432 and a Section 3 Action Plan in accordance with Title 24 Part 75 Code of Federal Regulations. As such, the bidders/offerors must submit documentary evidence of minority and women business enterprises and Section 3 business concerns who have been contacted and to whom commitments have been made. Documentation of such solicitations and commitments shall be submitted with the bid. Moreover, the CONTRACTOR shall strive to meet the MBE goal of 5% and the WBE goal of 3% for contracts of $25,000 or more. For projects which the amount of HUD or CDBG funding exceeds $200,000 the CONTRACTOR must attempt to meet the minimum numerical goals of which 25% or more of the total number of labor hours worked by all workers on a Section 3 project are Section 3 workers, per 24 CFR Part 75.19; and 5% or more of the total number of labor hours worked by all workers on a Section 3 project are Targeted Section 3 workers, as defined in 24 CFR Part 75.21. Borough of McClure, in accordance with its Section 3 Action Plan, may provide a bid preference to a bidder who is a Section 3 business concern. MBE/WBE and Section 3 business concerns shall be afforded full opportunity to bid without discrimination. Davis-Bacon and Related Acts apply to this Project. Bids may be held by the Borough for up to 60 days from the date of opening for the purpose of reviewing the bids and investigating the qualifications of bidders prior to awarding the contract. The Borough reserves the right to reject any or all bids, to waive any irregularities, or to negotiate contract amounts. The project is federally funded and subject to all related federal regulations. Awards shall be made only to responsible bidders that possess the potential ability to perform successfully under the terms and conditions of this procurement. Consideration shall be given to such matters as bidder integrity, compliance with public policy, record of past performance and financial and technical resources when determining responsibility.
