1. What This Policy Covers

This AI Use Policy (“Policy”) describes how Bid Banana uses artificial intelligence across its products and services, how your content is handled in connection with those features, and the limitations, disclaimers, and responsibilities that apply to your use of them. It applies to all AI features operated by Bid Lab Technologies, LLC (“Bid Banana,” “we,” “us,” or “our”), including the Self-Serve Tool, AI-assisted features within our Search service (such as opportunity matching, identification of similar or related opportunities, and extraction or summarization of information from solicitation documents), AI-assisted matching within our company profile and matching features, and any AI features made available through our API.

This Policy does not apply to, and is separate from, the human-staffed consulting services provided by Bid Lab LLC, which are governed by The Bid Lab AI Use Policy. The Self-Serve Tool and Bid Banana’s other AI features are automated and are not reviewed by a human before output is made available to you, except where we expressly state otherwise. Capitalized terms not defined here have the meanings given in the Bid Banana Terms of Use.

2. How the Self-Serve Tool Works

When you use the Self-Serve Tool, you upload or provide solicitation documents and other inputs, and the tool generates draft proposal content in response (“AI Output”). To do this:

(a) Generation. We use a third-party artificial-intelligence provider to generate and refine AI Output based on your inputs.

(b) Your Library. We use a third-party provider to create vector representations (“embeddings”) of your uploaded materials and past proposal content, which we retain in a library associated with your Account (“Your Library”). Your Library allows the Self-Serve Tool to identify and surface your own relevant prior content when generating AI Output for new solicitations. Your Library is built from your own content and is not shared with, or used to generate output for, other Bid Banana accounts.

(c) Provider processing and retention. Content you submit to the Self-Serve Tool is shared with our artificial-intelligence providers solely to provide the features described above. It is not used by those providers to train their own models. Content is retained by those providers in accordance with their respective data retention and security policies in effect from time to time. We do not sell your content to those providers or anyone else.

(d) Our own use. We use the content you submit, together with AI Output, to operate, maintain, and improve the Self-Serve Tool — including to build and maintain Your Library and to work effectively with the third-party providers described above. We do not train or fine-tune any artificial-intelligence model of our own on your content.

3. AI in Our Other Services

In addition to the Self-Serve Tool, we use artificial intelligence in other parts of the Services:

(a) Search and opportunity intelligence. We use AI to match opportunities to your profile and interests, to identify similar or related opportunities, and to extract and summarize information from solicitation and opportunity documents. These outputs are automated and may be incomplete or inaccurate — including wrong or outdated deadlines, requirements, or details, and matches that are not in fact relevant or suitable. You are solely responsible for independently verifying any match, summary, or extracted detail against the original source before relying on it.

(b) Company profiles and matching. We may use AI to suggest, rank, or facilitate matches between businesses, buyers, and partners based on profile, activity, and opportunity information. Any such suggestions are automated, are not endorsements or recommendations, and do not verify the suitability, qualifications, or legitimacy of any party. You are responsible for your own due diligence.

(c) API. Where we make AI features available through our API, the same limitations described in this Policy apply, and your responsibility to review and verify AI outputs applies in full at any scale at which you use them.

The general principles in this Policy — that AI outputs are automated, are generated without human review unless expressly stated, will contain errors, are not professional advice, and must be independently verified by you — apply to all of these features. Sections 4 through 11 describe these principles in the specific context of the Self-Serve Tool; the same principles apply to the AI features described in this Section.

4. AI Output Has No Human Review

AI Output is generated entirely by automated systems. No Bid Banana or Bid Lab employee, contractor, or professional reviews, verifies, or approves AI Output before it is made available to you. This is different from The Bid Lab’s human-staffed consulting services, where a qualified professional reviews work product at each key stage. For the Self-Serve Tool, you are the sole reviewer of AI Output, at every stage, before you rely on it, submit it, or use it for any purpose.

5. AI Output Will Contain Errors

AI Output is generated using probabilistic models and will contain errors. This includes, without limitation: factual inaccuracies; fabricated (“hallucinated”) information, including fabricated citations, statistics, or claims of qualification or experience; omissions of required content; incorrect or incomplete interpretations of solicitation requirements; miscalculations; outdated information; and content that is non-compliant or non-responsive to the applicable solicitation. AI Output may also inaccurately or incompletely reflect content drawn from Your Library, including outdated versions of past proposal content.

6. Certifications and Eligibility Claims

AI Output may reference, draft, or incorporate language relating to certifications, set-aside eligibility, or similar status representations (for example, small business, veteran-owned, service-disabled veteran-owned, 8(a), HUBZone, women-owned, or similar designations) where such content appears in your inputs, solicitation materials, or Your Library. The Self-Service Tool does not verify your eligibility for any certification or status, and AI Output is not a certification, legal opinion, or compliance determination of any kind. You are solely responsible for independently confirming the accuracy of any certification, eligibility, or status representation before it is submitted in connection with any bid or proposal. Misrepresenting eligibility or certification status in a submission to a government solicitation can carry significant civil and criminal consequences, including under the federal False Claims Act and comparable state statutes, and those consequences are yours alone, not Bid Banana’s, to bear.

The Self-Serve Tool may also generate assessments, scores, summaries, or statements about your proposal or its readiness, for example, indicating that a response is strong or complete, that your bid appears compliant or responsive, that your outline or structure satisfies the solicitation’s requirements, that required documents or sections are present, or similar evaluative or confirmatory statements. All such statements are automated, probabilistic outputs generated without human review, and are not assurances, guarantees, certifications, legal opinions, or compliance determinations of any kind. They do not confirm that your proposal is complete, compliant, responsive, accurate, or eligible for award, and they must not be relied upon as a substitute for your own review.

You are solely responsible for independently and comprehensively verifying every aspect of your proposal, including its accuracy, completeness, compliance with all solicitation requirements and instructions, formatting, required forms and attachments, and eligibility, before submission, regardless of any statement, score, or indication to the contrary generated by the Self-Serve Tool. Any reliance on AI Output, including any evaluative or confirmatory statement, is at your own risk, and the consequences of a non-compliant, incomplete, or inaccurate submission are yours alone to bear.

7. No Guarantees

We do not warrant that AI Output is accurate, complete, compliant, original, or fit for any purpose, and we do not guarantee any outcome, including that any proposal will be accepted, scored favorably, deemed responsive, or awarded. AI Output is a starting draft only.

8. Not Professional Advice

AI Output is not legal, procurement, compliance, financial, or other professional advice, and your use of the Self-Serve Tool does not create an advisory, consulting, or professional relationship of any kind between you and Bid Banana or Bid Lab. If you need professional guidance on a specific bid or compliance question, consider engaging The Bid Lab’s consulting services or independent counsel.

9. Optional Expert Review

If Bid Banana offers users the option to request human expert review of Self-Serve Tool output (“Expert Review”), the following applies: Expert Review is a separate, optional, additional service and is not part of the Self-Serve Tool. Sections 4 through 8 above continue to apply in full to any AI Output that has not actually undergone Expert Review. Requesting or purchasing Expert Review for one project does not change the no-review baseline for any other project, and does not retroactively apply to AI Output you have already relied on or submitted. Expert Review, if offered, is governed by The Bid Lab AI Use Policy and any applicable engagement terms, not by this Policy.

10. Data Handling

Our collection, use, retention, and disclosure of personal information in connection with the Self-Serve Tool, including Your Library, is described in the Bid Banana Privacy Policy. In summary: content you submit is used to generate AI Output and to build and maintain Your Library as described in Section 2 above; it is shared with our third-party artificial-intelligence providers solely to provide those features and is not used by those providers to train their own models; and we do not sell your content. You are responsible for ensuring you have the right to submit any content — including third-party or confidential material contained in a solicitation — for processing as described in this Policy.

11. Your Responsibility

Before relying on, submitting, or otherwise using any AI Output, you are solely responsible for reviewing, verifying, fact-checking, editing, and correcting it, including verifying: compliance with all solicitation requirements; the accuracy of any certification or eligibility representation (Section 5); formatting and submission rules; and applicable deadlines. Bid Banana’s total liability arising out of or relating to the Self-Serve Tool is governed by Section 17 of the Terms of Use.

12. Changes to This Policy

We may update this Policy from time to time. We will post the updated Policy with a new effective date. Your continued use of the Services after the effective date of an update constitutes acceptance of the updated Policy.
