NOTICE TO BIDDERS Sealed Proposals, invited by the County of Nassau, will be received by the County Executive of Nassau County, in the office of the Clerk of the Nassau County Legislature, Room 117, in the Theodore Roosevelt Executive and Legislative Building, 1550 Franklin Avenue, Mineola, New York, on Tuesday, September 29th, 2026 until 10:30 am, at which time the Proposals were accompanied with and presented separate from the required Bid Security will be publicly opened and read aloud, in the Meeting Room of the Nassau County Legislature, and the contract awarded as soon thereafter as practicable for: Nassau County Department of Public Works Merrick Avenue Signal Expansion Contract No. T62461-01G PIN 0761.44 The scope of work involves the construction of twenty-three (23) traffic signals and ten (10) traffic cameras at various intersections along Merrick Avenue, and Jerusalem Avenue. Your bid shall be based upon a Notice to Proceed to be issued in the 1st Quarter of 2027. All questions regarding this contract shall be submitted via email prior to 4:00 pm on Thursday, September 10th, 2026, to Michael Hagan at [email protected]. No interpretation of the meaning of the Drawings, Specifications or other Contract Documents will be made to any Bidder orally. Prospective bidders must request in writing such interpretation from the Commissioner and such interpretation will be given in writing in the form of written addenda, to all prospective bidders, in accordance with the Instructions to Bidders, Item G. Please be advised that the DBE goal for the subject County Federal Aid Project was set at 0%. The Project also has a 5.8% EEO Minority participation goal along with a 6.9% EEO Female participation goal. Project has federal funding. Federal reporting and NYSDOT record keeping requirements are included as part of the contract documents. The use of the NYSDOT approved civil rights reporting software, Equitable Business Opportunities (EBO), is required. To be in compliance with the contract requirements for NYS Civil Rights reporting, it is recommended that all Bidders and subcontractors have an active EBO account. Additionally, for Federal Aid projects, bidders shall submit Nassau County Utilization Plan, NYS LPM Appendix 12-10 and 12-1A with their bid. Note, all references to DBE goal in the attached Local Project Manual are not applicable to this contract. This Contract will be subject to Nassau County Local Laws No. 14-2002, “Participation by Minority Group Members and Women in Nassau County Contracts,” which requires submission of a Utilization plan prior to the award of a County contract, No. 2-2016, “Participation of Service-Disabled Veterans in County Contracts,” and No. 9-2002, as amended by No. 3-2015, which require that firms entering into contracts with Nassau County must participate in registered and approved apprenticeship training programs unless such requirement are supplanted by requirements specified in the bidding instructions. At the time of bid submission, the Contractor shall submit, as part of its bid, documents in compliance with Title 51 of the Nassau County Miscellaneous Laws demonstrating participation in approved apprenticeship training programs that are appropriate for the type and scope of work to be performed pursuant to the Contract. Such apprenticeship training programs appropriate for the scope of this Contract shall include, but are not limited to the following: Laborers, Electricians, Operating Engineers, or any other trade appropriate for the type of work proposed. The apprenticeship training programs shall be registered with, and approved by, the New York State Commissioner of Labor in accordance with Article 23 of the New York State Labor Law. Note that if the Contractor does not comply with these requirements, the Commissioner may declare the Contractor's bid proposal non-responsive and award the Contract to the next lowest responsible Bidder. SUBCONTRACTOR LISTS - In accordance with GML § 101, for projects (1) to which a project labor agreement applies, (Labor Law Section 222) and, additionally, (2) on a public work contract for which separate specifications have not been prepared, each Bidder shall submit with its bid a separate sealed list on the forms provided with the proposal forms that names each subcontractor (for the enumerated work, if applicable) that the Bidder intends to use to perform work on the contract. Notwithstanding the forgoing, all subcontractors must be approved by the Commissioner in writing prior to such subcontractor’s performance of any work. MWBE UTILIZATION PLAN – In accordance with Title 53, Nassau County Local Law No.14-2002, all bidders shall submit a MWBE Utilization Plan with their bid.
