RFR for HIC arbitrator services for SCA - FY25 and beyond

The Office of Consumer Affairs and Business Regulation is seeking arbitrators for the Home Improvement Contractor arbitration program. The arbitrators will resolve disputes between consumers and registered contractors and subcontractors. The arbitrators must have at least 3 years of legal experience, affiliation with a dispute resolution organization, or appointment to arbitrate by a judicial or governmental body. They must also have demonstrated ability in dispute resolution and own or have access to a portable digital recorder to record hearings. The arbitrators will be responsible for hosting hearings, issuing typed decisions, and providing an audible copy of the recording to the Office of Consumer Affairs and Business Regulation. Some key points to consider: • The arbitrators will be appointed from an approved list and will be responsible for conducting fair and impartial hearings. • The arbitrators must have the technical capacity to host hearings and issue typed decisions within 14 business days of the close of the hearing. • The arbitrators will be paid directly by the homeowners and contractors, and the fees will be based on the amount of damages being sought. • The arbitrators must comply with the standards set out in M.G.L. c. 142A and 201 CMR 14.00. • The arbitrators may be subject to training sessions specific to the provisions of M.G.L. c. 142A and 201 CMR 14.00 every 3 or more years.
