Legal Services Bids and Bidding Guide
You qualify for a legal services contract by proving three things: that your firm has done the specific work the buyer is asking for, that you meet the administrative requirements covering licensing, insurance, conflicts and registration, and that your rates are clear and defensible. Buyers score legal proposals on evidence rather than adjectives, so the firms that win are usually the ones that answer the published evaluation criteria in the order the solicitation lists them.
This guide covers what evaluators actually score, how to qualify before you draft, how to price a legal response, and what a panel appointment is worth. If you are still looking for solicitations to respond to, our companion guide on where to find legal RFPs covers the sources.
What Do Buyers Score in a Legal Services Proposal?
Read the evaluation criteria section before anything else, because it tells you the weighting and therefore where to spend your effort. Across most legal solicitations, four things carry the score.
- Relevant matter experience — Matters of the same type, in the same jurisdiction, for the same kind of client. Three closely comparable engagements beat twenty unrelated ones, and vague references to “extensive experience” score nothing.
- The named team — Buyers hire people, not letterhead. Name the partner and associates who will do the work, their bar admissions, their years in that practice area and what each one will handle.
- Capacity and conflicts — A direct statement that you can absorb the volume described, and that you have run a conflicts check against the parties named in the solicitation. Silence here reads as risk.
- Rates and cost control — Not only the number, but how you keep it predictable: staffing mix, billing increments, matter budgets, what gets written off, and who reviews the bill before it goes out.
Competition for this work is real. The Bureau of Labor Statistics counted 863,700 lawyer jobs in the United States in 2025, at a median annual wage of $159,670, and projects 5 percent growth in the occupation through 2035.
How Do You Qualify Before You Draft?
Spend an hour on the mandatory requirements before you spend a week on the narrative. A response that is technically excellent and administratively non-compliant is usually rejected before it is scored.
- Licensing — Confirm the attorneys you name are admitted in the jurisdiction, or that admission pro hac vice is acceptable to the buyer for the matters described.
- Insurance — Professional liability limits are usually specified. Get a certificate from your carrier showing the required limits before you promise them in writing.
- Registration — Federal work requires an active SAM.gov entity registration with a Unique Entity ID. State and local portals have their own vendor registration, which is often what puts you on the list that receives addenda.
- Conflicts — Run the check on day one. Discovering a conflict after submission wastes the bid and can damage a relationship you were trying to build.
- Set-aside status — Some solicitations are reserved for small, minority-owned, women-owned, veteran-owned or disadvantaged businesses. Certification can take weeks or months, so start it well before you need it rather than when a deadline appears.
How Should a Law Firm Price a Legal RFP Response?
Price to the structure the buyer asked for, and show your reasoning. Public buyers usually want hourly rates by timekeeper level, blended or capped and held firm for the contract term. Corporate panels often ask for alternative fee arrangements instead: fixed fees by matter type, monthly retainers, or capped budgets with a shared saving.
Look at what similar contracts have gone for before you set a number. Published tabulations and prior awards show what an agency has paid and who held the work, which is much better information than an internal guess. Our guide to using previous wins to better your bid walks through reading that data.
State every cost the client will actually see: rates by role, any escalation over the term, how expenses and disbursements are handled, travel, document hosting, and the staffing you would use for volume review. Leaving a cost out reads either as an oversight or as a change order waiting to happen, and evaluators treat it as both.
What Is Panel Counsel, and Is It Worth Bidding For?
A panel is a prequalified list of firms a client will use for outside work over a set term, usually several years, often with renewal options. Corporate legal departments and public agencies both run them, usually to consolidate a long, unmanaged list of firms into a shorter one with agreed rates.
Appointment does not guarantee volume; it makes you eligible for it, and individual matters are still assigned or competed inside the panel. It is normally worth the heavier bid effort anyway, because once you are on, most matters afterward skip a full procurement, and panel terms are long enough to plan staffing around.
Which Parts of a Legal Response Can You Reuse?
Most of it, if you build it once and keep it current. A core file should hold the following, ready to drop into the buyer's format.
- Firm profile — Size, offices, practice areas, ownership structure and any certifications, in a version you can trim to a page.
- Attorney biographies — One standard format with bar admissions, practice focus and representative matters, refreshed at least twice a year rather than the week a bid is due.
- Matter descriptions — Short, anonymized summaries of representative engagements with the client type and the outcome, organized by practice area.
- References — Named contacts you have actually asked for permission, with current email and phone details, checked before each submission.
- Administrative attachments — Insurance certificates, W-9, registration numbers, conflicts policy, diversity data and your standard exceptions to contract terms.
Reusing that material is the difference between bidding once a quarter and bidding every month. Our guide to tracking RFPs and reusing content sets out a system for it, and an RFP response checklist keeps the reused pieces from going stale when several bids run at once.
What Should You Do Before the Question Deadline?
Put the written question deadline in your calendar the day you download the documents. It normally falls well before the submission date and it is your only chance to get an ambiguity resolved on the record. Ask about anything that changes your price or your risk: expected matter volumes, whether the incumbent is bidding, indemnity and limitation of liability language, e-billing requirements, rate escalation, and whether alternative fee proposals are acceptable.
Answers are usually published to every bidder, so a precise question also signals that you read the document carefully. If a pre-proposal conference is offered, attend it, and check whether attendance is mandatory, because on some solicitations it is a condition of eligibility.

FAQs
How do law firms qualify to bid on government legal contracts?
You need attorneys admitted in the jurisdiction, professional liability insurance at the limits stated in the solicitation, a completed conflicts check, and vendor registration with the buyer. Federal work also requires an active SAM.gov entity registration with a Unique Entity ID. Missing a mandatory item can make the response non-responsive regardless of quality.
What is panel counsel?
Panel counsel is a prequalified list of law firms a client agrees to use for outside legal work over a set term, usually several years. Appointment does not guarantee volume, but it makes your firm eligible for matters without a fresh procurement each time, which is why panels attract heavy competition.
How should a law firm price a legal RFP response?
Price in the structure the buyer requested. Public buyers usually want hourly rates by timekeeper level held firm for the term; corporate panels often prefer fixed fees per matter type or capped budgets. State escalation, expenses, travel and document hosting explicitly, and check prior award data before setting a number.
What do evaluators look for in a legal services proposal?
Relevant matter experience in the same jurisdiction and for the same kind of client, the named attorneys who will actually do the work, a clear statement of capacity and conflicts, and a rate structure with cost controls. Answer in the order the evaluation criteria are listed, using the buyer's own section numbering.
Can a small law firm win a public legal services contract?
Yes, and often more easily than a large one. Agencies frequently buy narrow specialist work such as bond, land use, labor or hearing officer services, where depth in one area beats breadth. Some solicitations are also set aside for small, minority-owned, women-owned or veteran-owned businesses.
