The Oregon State Lottery is seeking offers to purchase its surplus Video Lottery Terminals (VLTs). The VLTs are Spielo, model Oxygen, and are described in Exhibit A. The Lottery estimates that up to 3015 VLTs may be available for purchase, and the VLTs will be removed from retail sites over the next three years. The successful Offeror will be required to purchase the VLTs at the Offer price, and the Lottery will remove all Lottery-specific identifiers, including its software, certification decal, and locks and barrels from the VLTs. The Offeror will be responsible for all costs incurred for the preparation or submission of an Offer, including any costs incurred for travel or labor to inspect the VLTs. The Lottery reserves the right to reject any Offer, and the Offeror shall comply with all applicable federal, state, local, and multijurisdictional laws, ordinances, rules, and regulations pertaining to the registration, licensing, handling, possession, transportation, transfer, import, export, processing, manufacture, sale, use, or disposal of the VLTs. Key points to consider include:
* The Offeror must submit one signed Offer Form and one Pricing Page via email to the Analyst by the Offer due date and time.
* The Offeror shall provide all information requested under Section Three, the Pricing Page, and under Section Four, the Offer Form of this RFO.
* The Offeror must clearly show in the space provided the quantity, unit price, and total price offered for the desired quantity of VLTs.
* The Lottery may award one or more Contracts, and the Offeror offering the highest price shall be awarded a Contract for the quantity described in Offeror’s Offer, up to the total estimated quantity available.
* The Contract Award does not provide the Offeror any rights to select VLTs based on aesthetics or specific subassemblies contained within the VLTs.
* The Offeror shall pay the Offer unit price to the Lottery within 10 Business Days following receipt of notice from the Lottery that the VLTs are available for pick up.
* The Lottery will not release VLTs to the Offeror prior to the Offeror making payment in full to the Lottery, at the price set forth in Exhibit A, for the VLTs that are the subject of the shipment being released.
* The Offeror shall ensure that no more than one transport trailer is at the Lottery’s facilities at a time and shall ensure immediate replacement of each transport trailer leaving the Lottery until all VLTs identified in the Authorization for Transportation of Video Lottery Terminals have been removed from the Lottery’s facilities.
